Article 1 – Who are we?
Handymat Services is a sole proprietorship (eenmanszaak) providing handyman, repair, renovation and IT services to private individuals.
Owner: Matthias Merx, Europaweg 1489, 2035 LA Haarlem, info@handymat.nl, www.handymat.nl, KvK: 42120954, VAT: NL005510398B69.
Article 2 – Applicability
These terms and conditions apply to all our agreements. These terms are included with the quote. By digitally accepting the quote, you confirm that you have read these terms and agree to them.
Article 3 – Quote and cost estimate
- Every assignment begins with a quote. The quote describes the work to be carried out, including a cost estimate. No work will commence without the client's approval.
- The quote is valid for 7 days.
- Additional work will only be carried out after the client's digital approval and will be invoiced separately.
- If the final price exceeds the cost estimate by more than 10%, the client will be informed in advance and asked for approval.
Article 4 – Performance
- Handymat Services will carry out the work to the best of its ability and will leave the work area clean.
- Scheduled dates are indicative. In the event of delay, the client will be informed as soon as possible.
- If a job requires the involvement of third parties, this will be arranged in consultation with the client.
- The client will provide access to the work area and will report in advance any hidden pipes or cables, structural elements or other risks.
- For work carried out on a time-and-materials basis (hourly rate), the client will receive an overview of the hours spent and materials used after completion. Objections to this overview must be submitted digitally within 7 days.
Article 5 – Rates and payment
- Rates include VAT.
- Material costs are invoiced separately. Materials up to €25.00 are listed on the final invoice afterwards. Materials over €25.00 purchased specifically for the assignment are invoiced to the client in advance.
- Private clients settle payment immediately after completion, by card, Tikkie (a Dutch payment request app), cash or bank transfer.
- For assignments spanning multiple days, a deposit of up to 30% may be requested, explicitly stated in the quote.
Article 6 – Cancellation
- Cancellations must be communicated digitally (for example by email or WhatsApp).
- The client has the right to cancel the assignment at any time. Handymat Services will only charge for demonstrably incurred costs, such as materials already ordered or hours that could not be used elsewhere.
- Handymat Services will make reasonable efforts to reschedule any reserved time in order to limit costs.
- Handymat Services may also cancel an assignment, for example in the event of illness or force majeure. The client will be informed as soon as possible and a new date will be scheduled in consultation. In that case, no costs will be charged to the client.
Article 7 – Completion
- After completing the work, Handymat Services will invite the client to inspect the work together. Any defects identified will be recorded digitally.
- If the client does not respond to an invitation to inspect the work, the work is deemed completed. The client then has 8 days to report defects digitally via info@handymat.nl.
- Minor defects that do not prevent normal use are not grounds for refusing completion. Handymat Services will remedy these within a reasonable period.
- After completion, the work is at the client's expense and risk.
Article 8 – Liability
- Handymat Services is liable for damage that is the direct result of an error during execution of the work, in accordance with the statutory provisions applicable to contracts for work with consumers.
- Handymat Services holds business liability insurance. Damage will be reported to the insurer.
- Damage must be reported digitally within 7 days of discovery via info@handymat.nl.
- Handymat Services is not liable for damage caused by hidden defects in existing structures or by materials supplied by the client.
Article 9 – Force Majeure
Force majeure means circumstances beyond the control of Handymat Services, including illness, weather conditions and material shortages. In the event of force majeure, the client will be informed as soon as possible. In such cases, Handymat Services is entitled to suspend performance without being liable for any compensation.
Article 10 – Complaints
Complaints must be reported digitally as soon as possible, and no later than 14 days after the work was carried out, via info@handymat.nl. Handymat Services will respond within 5 business days and will aim to resolve the matter through mutual consultation.
Article 11 – Privacy
Personal data is used solely for carrying out the assignment and is not shared with third parties.
Article 12 – Disputes and competent court
- Dutch law applies to all agreements.
- Disputes will preferably be resolved through mutual consultation.
- If this is not possible, the court in the district of the consumer's place of residence has jurisdiction, unless the consumer chooses the court in the district of Handymat Services (Haarlem).
- Consumers can also make use of the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
